How does Ducati get away with this?

I know that plans for a steet going Desmosedici have been in the works for quite some time, but now that the details and pics are out, the similarities to the actual GP bike are astounding. So how does Ducati get to race a bike in a series for prototypes that it produces and sells as well? Is it a “chicken or egg” thing? In other words, which came first?

I don't think the FIM tech regs. have a stipulation against making a replica of their MotoGP bike. Only that you cannot race anything with a production base- like what WCM tried to do with their modified -R1 engines.
Besides, Ducati's production bikes are all v-twins. And since it's a 2007 model, the GP bikes will be 800cc by then. Not 990.
